¿Interpretar para cambiar? Las transformaciones del Comité de la ONU sobre los derechos de las personas con discapacidad

Resumen

Este artículo analiza críticamente la interpretación evolutiva adoptada por el Comité de la ONU sobre los Derechos de las Personas con Discapacidad en sus Observaciones Generales n. 1 y n. 7. Aunque este enfoque permite adaptar la Convención a cambios sociales contemporáneos, también plantea interrogantes sobre la legitimidad institucional del Comité, en particular cuando sus interpretaciones parecen introducir obligaciones no previstas explícitamente en el texto convencional. El estudio subraya que la creciente influencia normativa del Comité contrasta con la ausencia de poderes coercitivos y con la falta de mecanismos sólidos de supervisión externa y de rendición de cuentas. Asimismo, se advierte contra la frecuente equiparación entre la labor interpretativa del Comité y la jurisprudencia del Tribunal Europeo de Derechos Humanos, dada la diferencia esencial entre una autoridad jurisdiccional vinculante y un órgano cuasi consultivo. Finalmente, se sostiene la necesidad de clarificar el mandato del Comité para preservar la coherencia y la previsibilidad del sistema internacional de derechos humanos.
